Frequently Asked Questions
Does the FTC Safeguards Rule really apply to my CPA firm?
In most cases, yes. Under 16 CFR Part 314, an accountant or tax preparation service that completes income tax returns is treated as a financial institution, and the IRS has stated that tax and accounting professionals are covered regardless of firm size. The rule has been enforceable since June 2023. Confirm your specific obligations with your compliance counsel - we handle the technology side and the documentation that supports your program.
What does the Safeguards Rule require us to have in place?
At a high level: a written information security program, a designated Qualified Individual responsible for it, a documented risk assessment, access controls and multi-factor authentication, encryption of customer information, monitoring and logging, vendor oversight, security awareness training, and an incident response plan. There is also a breach notification requirement to the FTC within 30 days for incidents involving 500 or more consumers. We implement and document the technical controls that sit underneath those requirements.
Can you act as our Qualified Individual?

It provides ongoing security oversight, annual risk assessment support, policy review, and a named person who can explain your security program to your board, your insurance carrier, or an examiner. Whether that person is formally designated as your Qualified Individual is a decision to make with your compliance counsel.
Do you work with SEC-registered advisors and FINRA member firms?
Yes. Registered investment advisors and broker-dealers carry obligations under Regulation S-P, Regulation S-ID, and FINRA Rules 3110 and 4370, including written incident response, vendor risk oversight, and multi-factor authentication coverage. We build to those expectations and maintain the records examiners typically request.
